DMCA NOTICE
XReelz respects the intellectual property rights of others and expects all users and creators to do the same. If you believe that your copyrighted work has been used, uploaded, or shared on XReelz without your permission, you have the right to submit a copyright infringement notice under the Digital Millennium Copyright Act (DMCA).
Once we receive a valid notice, we will review the claim and remove or disable access to the content that appears to infringe your rights. We may also take action against the account responsible for the upload, in line with our Terms of Service and Community Guidelines. Anyone who submits a DMCA notice must ensure that the information they provide is accurate and truthful, as submitting false or misleading claims may lead to legal consequences.
a) Designated Agent (the "DMCA Agent") for DMCA Notices
In compliance with the Digital Millennium Copyright Act (DMCA), Qylo B.V. designates the following agent to receive notifications of claimed copyright infringement:
- Name: Luke van Kooten and Thijs Maarse
- Email: info@xreelz.com
- Postal: Staverenstraat 15, 7418 CJ Deventer, The Netherlands
b) Filing a DMCA Notice
If you believe that material available on our website infringes your copyright, you must send a written notification to our designated DMCA Agent at info@xreelz.com. To be effective under the DMCA, your notice must include all of the following (see 17 U.S.C. § 512(c)(3)):
- Signature of copyright owner or person authorized to act on behalf of the owner;
- Identification of copyrighted work claimed to be infringed;
- Identification of the material claimed to be infringing or to be the subject of infringing activity and information reasonably sufficient for us to locate the material;
- Information reasonably sufficient to permit us to contact the complaining party (address, phone number and, if available, email address);
- A statement that the complaining party has a good faith belief that use of the material in the manner complained is not authorized by the copyright owner, its agent, or the law; and
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of the exclusive right allegedly being infringed.
There are substantial penalties for false claims (see 17 U.S.C. § 512(f) - providing sanctions for material misrepresentations of copyright infringement).
c) Counter-Notification
If you believe that your material was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification containing:
- Your physical or electronic signature;
- Identification of the material that was removed or disabled and the location where it previously appeared;
- A statement under penalty of perjury that you have a good faith belief that the removal or disabling was due to mistake or misidentification;
- Your name, postal address, telephone number, and email address;
- A statement that you consent to the jurisdiction of an appropriate court with authority over such matters, and that you will accept service of process from the person who submitted the original DMCA notice or their agent.
d) Resolution of Claims
Upon receiving a valid counter-notification, we may restore the material within ten (10) to fourteen (14) business days unless the original complainant notifies us that they have filed a legal action seeking to restrain the alleged infringement. XReelz reserves the right to take additional actions where required by applicable law.
e) Repeat Infringer Policy
Pursuant to Section 512 of the DMCA, it is our policy to terminate the account of any repeat copyright infringer in appropriate circumstances.
f) False Claim
Knowingly submitting false or materially misleading notices or counter-notices may expose you to liability for damages, including costs and attorney's fees, under 17 U.S.C. § 512(f).
