Although our platform is operated outside the United States, XReelz voluntarily complies with the record-keeping requirements of 18 U.S.C. §2257, 18 U.S.C. §2257A, and 28 C.F.R. Part 75 ("Section 2257") to the extent possible under applicable Dutch and EU law, because content hosted on the platform may be accessed within the United States.

Content Subject to Section 2257

All models, actors, actresses, and other persons who appear in any visual depiction of actual or simulated sexually explicit conduct appearing on XReelz were over the age of eighteen (18) at the time the visual image was produced. Creators who upload such content are fully responsible for keeping and maintaining all records required by Section 2257 and for certifying that all performers are adults.

Exempt Content

All other visual depictions displayed on XReelz are exempt from the record-keeping requirements of Section 2257 because:

1. they do not portray conduct listed in 18 U.S.C. §2256(2)(A)(i)–(iv);
2. they do not portray conduct listed in 18 U.S.C. §2257A produced after March 19, 2009;
3. they do not portray conduct listed in 18 U.S.C. §2256(2)(A)(v) produced after March 19, 2009;
4. the visual depictions were created prior to July 3, 1995; or
5. XReelz does not act as a "producer" with respect to the dissemination of such exempt images as defined in 28 C.F.R. §75.1(c).

Platform Status - Not a Producer

XReelz does not create, commission, film, hire, direct, or participate in the production of any content uploaded to the platform. For all content uploaded to XReelz, the uploading creator is the sole "producer" for purposes of 18 U.S.C. §2257 and §2257A.

XReelz does not collect, store, inspect, or maintain 2257 records for any creator or performer. XReelz verifies only the age and identity of uploaders (creators), not any other performers appearing in their content.

Creator Obligations

Creators uploading content that includes actual or simulated sexually explicit conduct must:

• ensure all performers are at least 18 years old at the time the content was produced;
• maintain all records required under 18 U.S.C. §2257 and §2257A;
• include proper 2257-compliant notices on their content where required;
• make such records available to U.S. law enforcement upon request;
• remove or report any material involving minors or suspected minors.

Moderation Disclaimer

Any moderation or review performed by XReelz is solely for safety, legal compliance, and enforcement of platform policies such as our Terms of Service. Such moderation does not involve participating in, altering, editing, directing, or producing any content and does not make XReelz a primary or secondary producer under Section 2257.

Removal of Non-Compliant Content

If we become aware of any content that may involve a minor, has missing age assurance, or is otherwise non-compliant, we will immediately remove or disable access to the content and may suspend or permanently remove the responsible creator.

Records Custodian

All records required to be kept under Section 2257 for visual depictions of actual or simulated sexually explicit conduct appearing on XReelz are maintained by the individual creators who upload such content. Records maintained by creators will be made available to authorized inspectors by the creator's designated records custodian.
